  • 9. TERMS OF ENGAGEMENT (TEMPORARY CANDIDATES ONLY)

    If you are seeking temporary work, we are legally required to (1) agree the basis on which you contract with us before we can provide working-finding services to you and (2) provide you with certain information about our preferred umbrella and intermediary companies. However, agreeing a contract with us does not obligate you to work through Bond Recruit Ltd and you are free to change your decision before commencing as assignment

  • OPTION A - PAYE WORKER

    • I wish to be engaged by Bond Recruitment (a trading name of Quba Solutions Ltd) as a PAYE agency worker. I have read and agree to the attached Contract for Services - Agency Worker (Contract 1)

    • I wish to Opt Out of the Working Time Regulations 1998 so that I may work more than 48 hours per week on average. I understand that I may withdraw this opt out by giving Bond Recruitment one month's notice in writing.
  • OPTION B - umbrella

    Our preferred umbrella companies are XXXXXXX. Please refer to the Intermediary Company - Information Sheet for more details. We encourage you to select one of our preferred umbrella companies as we are satisfied that they are compliant and provide a high level of customer service. We will consider other umbrella companies provided that they meet a minimum level of compliance and agree to our contractual terms. If we are unable to accept your preferred umbrella company, we will ask you to select an alternative provider.
    • I have read and agree to the attach Contract for Services - Agency Worker. (Contract 1) I understand that the main body of the agreement and Schedule 1 will apply during the period of work-finding services. During an assignment, I understand that my contract will be with the umbrella company rather than with Bond Recruitment.

  • OPTION C - CIS THROUGH INTERMEDIARY

    Our approved CIS intermediary companies are XXXXX. Due to the legal and financial risks associated with engaging CIS subcontractors, we are unwilling to consider any alternative CIS intermediary companies at this time.

    Please note that you cannot be engaged as a CIS Subcontractor unless the client has confirmed that you will not be subject to supervision, direction or control as to the manner in which you perform the assignment. If the client does not provide this confirmation, you will be required to choose an alternative form of contracting at the relevant time.

    • I have read and agree to the attached Contract for Services - Agency Worker (Contract 1). I understand the main body of the agreement and Schedule 1 will apply during the period of work-finding services. During as assignment, I understand that my contract will be with the CIS intermediary company and not with Bond Recruitment

  • OPTION D - LIMITED COMPANY (OUTSIDE IR35)

    • On behalf of the above Limited Company, we agree to the attached Contract for Services (Contractors) (Contract 2). We undertake to update Bond Recruitment immediately if there is any change to our tax or company status.

    • Under the Conduct of Employment Agencies and Employment Business Regulations 2003, contractors are given employment type protection, eliminating the commercial risk associated with being outside of IR35. IF YOU INTEND TO OPERATE OUTSIDE OF IR135, YOU SHOULD STRONGLY CONSIDER OPTING OUT OF THE CONDUCT REGULATIONS.

      If either party decides to withdraw the Opt Out, they may do so by notifying us in writing. Any withdrawal will be effective from the end of any Assignment which is in progress at that time.

      To validly Opt Out, please ensure that both sections are signed, even if the same person signs both sections:

    • Contractor Opt Out

      On behalf of the above limited company Contractor, we wish to Opt Out of the Conduct of Employment Agencies and Employment Businesses Regulations 2003 under Regulation 23(9).

  • I consent to Bond Recruit Ltd representing me and seeking suitable engagement for me within the construction sector in the position which I have indicated in section 3 of this form or one which is similar.

    I understand that (1) Quba Solutions Limited (trading as Bond Recruit) will be acting as an Employee Business when providing temporary work-finding service to me and (2) Bond Recruit Ltd will be acting as an Employment Agency if providing permanent work-finding services to me. I understand that Bond Recruit Ltd has no obligation to fine me any engagement and I am under no obligation to accept an offer of engagement which is made.

    I have completed this Registration Form to the best of my knowledge and have not omitted any relevant details. I will notify Bond Recruit Ltd of any changes to my details or circumstances at the earliest opportunity. I understand that I may incur criminal or civil liability for making any false or misleading statements and, if applicable, any recruitment process or assignment which is in progress at the relevant time may be terminated without notice.
